Is There A Time Limit For Wrongful Death Claims In Georgia?

The statute of limitations in Georgia disallows personal injury victims and/or their families from seeking compensation through a claim or lawsuit two years after the date of the accident. Under certain circumstances, such as lawsuits against municipalities, this window of opportunity is even shorter. If your loved one sustained an injury but lived for weeks, months, or even years after the incident, the court still calculates the statute of limitations from the date of the original accident.

Wrongful Death Lawsuit Eligibility In Georgia

Georgia law delineates a hierarchy of who can file a lawsuit for the wrongful death of a loved one. This means that only certain relatives have the right to file, leaving others without the option to seek financial compensation.

Spouse – Under Georgia law, surviving spouses have the primary right to seek compensation. However, if children survive the victim as well, the spouse can file a wrongful death lawsuit and split the award with the children.

Children – If the victim did not leave behind a spouse, but was survived by children, the children would have the primary right to seek compensation on behalf of their deceased parent. If there is an award, it would be split evenly.

Parents – In some cases, parents have the right to seek compensation for the wrongful death of their child. However, they would only be entitled to file a lawsuit if the victim was not survived by a spouse or any children.

Estate – If the deceased victim is not survived by a spouse, children, or living parents, a wrongful death lawsuit can be filed by the deceased’s estate. In this case, the estate would pass the claim to the victim’s next of kin.
